SMS / MMS Messaging Program Terms and Conditions

These Terms and Conditions ("Terms") govern the SMS / MMS messaging program operated by Landmark Machinery, LLC ("Company," "Landmark Machinery," "we," "our," or "us"). By providing your verbal consent during a phone call with our parts and service department to receive text messages from Landmark Machinery, you agree to be bound by these Terms.
1. Program Description
Landmark Machinery operates a customer-care SMS and MMS text messaging program used to support customers who contact our parts and service department for assistance with equipment that has broken down or requires service. Messages are sent only in connection with a specific service issue you have raised with us by phone, and may include:
- Parts identification photographs sent via MMS to help you identify replacement parts.
- Troubleshooting information for your specific equipment issue.
- Follow-up questions or clarifications related to your service issue.
This is not a marketing or promotional program. Messages are operational in nature and are sent only to customers who have contacted us first and provided verbal consent during the call.
2. Cancellation (STOP)
You can cancel the SMS service at any time. Just text "STOP" to the number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you contact us again later about a future service issue and want to receive texts, you will need to provide verbal consent again through the same call-based process.
3. Help (HELP)

4. Carrier Liability
Carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, MetroPCS, and Cricket Wireless, are not liable for delayed or undelivered messages.
5. Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on the nature and duration of your specific service issue. If you have any questions about your text or data plan, please contact your wireless provider.
6. Privacy
Your use of the messaging program is also governed by our Privacy Policy, available at https://www.landmarkmachinery.com/privacy-security/. Part I of the Privacy Policy describes how we collect, use, and protect mobile information specifically in connection with this program, including the carve-out that no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. A description of how we obtain your verbal consent is also publicly available at https://www.landmarkmachinery.com/sms-consent-process/.
7. Eligibility and Consent
Participation in the messaging program is limited to customers who have contacted Landmark Machinery's parts and service department by phone for assistance with a specific equipment service issue. Participants must be at least 18 years of age and must have the authority to use the mobile telephone number provided.
Consent to receive text messages is captured verbally during the support call, after the Landmark Machinery representative has read a script disclosing the purpose of the messages, the message and data rate disclaimer, the STOP and HELP keywords, and a reference to this document and the Privacy Policy. The verbal consent is documented in our internal customer service application before any text message is sent.
8. User Responsibilities
By participating in the messaging program, you agree:
- To provide a mobile telephone number that you own or are authorized to use.
- To promptly notify Landmark Machinery if your mobile number changes during the course of an active service issue.
- To use the messaging program only for legitimate communications related to the service issue you contacted us about.
- Not to forward, share, or repurpose messages or images received through the program in any way that violates applicable law, the Company's policies, or the rights of any third party.
9. Disclaimers and Limitation of Liability
The messaging program is provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, regarding the messaging program, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, Landmark Machinery, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the messaging program, even if the Company has been advised of the possibility of such damages.
10. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, technology, or applicable law. The most current version will always be posted at https://www.landmarkmachinery.com/terms-conditions/, with the "Effective Date" updated accordingly. Continued participation in the messaging program after changes are posted constitutes acceptance of the updated Terms.
