SMS / MMS Messaging Program Terms and Conditions

These Terms and Conditions ("Terms") govern the SMS / MMS messaging program operated by Landmark Machinery, LLC ("Company," "Landmark Machinery," "we," "our," or "us"). By providing your mobile telephone number to Landmark Machinery as part of your working relationship with the Company — including as a field worker, contractor, or employee — and by participating in the messaging program, you agree to be bound by these Terms.

1. Program Description

Landmark Machinery, LLC operates an internal business messaging program that uses SMS and MMS text messages to coordinate field-service work between Company personnel and authorized field workers, contractors, and employees. Messages may include:

  • Parts identification photographs sent via MMS to assist with on-site repair and service work.
  • Job assignments, schedule changes, and dispatch information.
  • Operational coordination and follow-up between Company personnel and field workers.
  • Responses to inbound questions from authorized recipients.

This is not a marketing or promotional program. Messages are operational in nature and are sent only to individuals who have an existing working relationship with the Company.

2. Cancellation (STOP)

You can cancel the SMS service at any time. Just text "STOP" to the number from which you received the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to rejoin the program, please contact your Landmark Machinery supervisor or Company contact, who will arrange to re-enroll your number.

If you opt out, please notify your supervisor or Company contact so that an alternative means of operational communication can be arranged for ongoing work assignments.

4. Carrier Liability

Carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, MetroPCS, and Cricket Wireless, are not liable for delayed or undelivered messages.

5. Message and Data Rates

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on operational needs. If you have any questions about your text or data plan, please contact your wireless provider.

Your use of the messaging program is also governed by our Privacy Policy and the SMS / MMS Communications Addendum, available at https://www.landmarkmachinery.com/privacy-security/. The Addendum describes how we collect, use, and protect mobile information specifically in connection with this program, including the carve-out that no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

7. Eligibility and Consent

Participation in the messaging program is limited to active field workers, contractors, and employees with a current working relationship with Landmark Machinery, LLC. Participants must be at least 18 years of age and must have the authority to use the mobile telephone number provided.

Participants provide their mobile telephone numbers to the Company as part of onboarding, hiring, or contractor engagement. By providing the number for the purpose of receiving operational text messages, the participant consents to receive SMS and MMS messages from the Company in connection with the working relationship.

8. User Responsibilities

By participating in the messaging program, you agree:

  • To provide a mobile telephone number that you own or are authorized to use.
  • To promptly notify the Company if your mobile number changes or if you no longer have access to it.
  • To use the messaging program only for legitimate business communications related to your working relationship with the Company.
  • Not to forward, share, or repurpose messages or images received through the program in any way that violates applicable law, the Company's policies, or the rights of any third party.

9. Disclaimers and Limitation of Liability

The messaging program is provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, regarding the messaging program, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, Landmark Machinery, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the messaging program, even if the Company has been advised of the possibility of such damages.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, technology, or applicable law. The most current version will always be posted at https://www.landmarkmachinery.com/terms-conditions/, with the "Effective Date" updated accordingly. Continued participation in the messaging program after changes are posted constitutes acceptance of the updated Terms.
