Landmark Machinery, LLC ("Landmark Machinery," "Company," "we," "our," or "us") respects your privacy and is committed to protecting the personal information we collect from you. This Privacy Policy describes how we collect, use, share, and safeguard information when you visit our website at www.landmarkmachinery.com, purchase products or services from us, or participate in our SMS / MMS messaging program. By using our services, you agree to the collection and use of information in accordance with this Privacy Policy.
This Privacy Policy is organized in two parts. Part I covers our SMS / MMS messaging program (10-digit long code, or "10DLC") and applies to text-message communications with our customers in connection with parts and service support. Part II is the general Privacy Policy that applies to your use of our website and services.
Part I — SMS / MMS Messaging Program
1. Scope of the Messaging Program
Landmark Machinery operates a customer-care SMS and MMS text messaging program, sent through 10-digit long code (10DLC) telephone numbers, used to support customers who contact our parts and service department for assistance with equipment that has broken down or requires service. This Part I governs information collected and used in connection with that program. In the event of any conflict between Part I and Part II of this Privacy Policy with respect to text messaging communications, Part I controls.
2. How Customers Are Enrolled (Opt-In)
The messaging program is customer-initiated. Customers contact Landmark Machinery's parts and service department by phone — typically from a remote job site where their equipment has broken down or requires service — and during the call, request or affirmatively agree to receive parts identification photographs and related troubleshooting information via SMS/MMS to their mobile phone.
Before any text message is sent, the Landmark Machinery representative completes a structured verbal opt-in workflow with the customer that:
- Confirms the customer wishes to receive text messages from Landmark Machinery for the specific service issue.
- Verifies the customer's mobile telephone number.
- Discloses that standard message and data rates from the customer's wireless carrier may apply.
- Advises the customer that they may reply STOP at any time to opt out and HELP for assistance.
- References this Privacy Policy and the SMS Terms and Conditions.
The verbal consent and required disclosures are documented in our internal customer service application, including the date, time, customer name, organization, mobile telephone number, the representative who took the call, and attestations confirming each disclosure was made and the customer agreed. Only customers who have completed this verbal opt-in are added to the program.

3. Information Collected Through the Messaging Program
In connection with the SMS / MMS program, we collect:
- Mobile telephone numbers provided by customers during their support call.
- Opt-in and opt-out records documented in our customer service system.
- Message content and metadata, including the content of text and multimedia messages exchanged between Landmark Machinery personnel and the customer (such as parts identification photographs and troubleshooting messages), as well as timestamps and message-delivery information.
- Equipment and service information related to the customer's specific service issue, to the extent it is included in the messages.
4. How We Use Information from the Messaging Program
Information collected through the SMS / MMS program is used solely for legitimate operational purposes, including:
- Sending parts identification photographs to help customers identify replacement parts for broken-down equipment.
- Sending troubleshooting information related to the customer's specific service issue.
- Responding to questions or follow-up requests from the customer related to the service issue.
- Maintaining records of communications for operational, warranty, and compliance purposes.
- Complying with applicable laws, regulations, and carrier requirements.
Messages are limited in scope to the specific equipment service issue raised by the customer. We do not use the messaging program for marketing or promotional communications.
5. Mobile Information Sharing — Carve-Out
No mobile information collected through the SMS / MMS program will be shared with third parties or affiliates for marketing or promotional purposes. All categories of information collected through the SMS / MMS program — including mobile telephone numbers, text messaging originator opt-in data, and consent records — will not be shared with any third parties for marketing or promotional purposes, will not be sold, and will not be transferred to affiliates or business partners for marketing or promotional purposes.
The general "Sharing," "Disclosure," and "Sale" provisions in Part II of this Privacy Policy do not apply to information collected through the SMS / MMS program.
We share SMS-program information only in the following limited circumstances:
- Service Providers necessary to deliver messages. With our SMS platform provider (Twilio) and the underlying mobile carriers responsible for message delivery. These providers are contractually obligated to protect the confidentiality and security of this information and to use it only to provide the messaging service.
- Legal Requirements. When required by law, regulation, subpoena, court order, or other legal process, or to protect the rights, property, or safety of the Company, our personnel, or others.
6. Message Frequency and Cost
Message frequency varies based on the nature and duration of the customer's service issue. A given customer may receive only one or two messages for a single service event, or may exchange a longer series of messages for more complex issues.
Landmark Machinery does not charge customers to send or receive messages. Standard message and data rates from your wireless carrier may apply.
7. Opt-Out and Help
You may opt out of receiving SMS and MMS messages from us at any time by replying STOP to any message you receive from us. After we receive your STOP request, we will send a single confirmation message acknowledging the opt-out, and you will receive no further text messages from the Company unless you contact us again and re-consent.

8. Data Retention — SMS Information
Records of opt-in consent and opt-out requests are retained for the period required by applicable law and industry guidelines. Other SMS-program information is retained as part of the customer's service record only for as long as necessary to fulfill the purposes described in this Part I, comply with legal and regulatory obligations, resolve disputes, and enforce our agreements.

Part II — General Privacy Policy
9. Information We Collect
Information You Provide Directly
When you create an account, place an order, contact us, or otherwise interact with our services, we may collect personally identifiable information, including:
- First and last name
- Email address
- Postal address
- Telephone number
- Order and transaction history
- Account credentials
Information Collected Automatically
When you visit our website, we automatically collect certain information about your device and usage, including IP address, browser type and version, operating system, the pages you visit, the time and date of your visits, time spent on pages, and other diagnostic data.
Information from Mobile Devices
If you access our services from a mobile device, we may collect device type, mobile device unique ID, mobile IP address, mobile operating system, and mobile browser type. With your permission, we may also collect approximate location and access photos from your device's camera or photo library when needed to provide a feature you request.
Cookies and Tracking Technologies
We use cookies and similar tracking technologies (including web beacons, tags, and scripts) to operate the website, remember your preferences, authenticate users, analyze site traffic, and measure the effectiveness of our content. We use both session and persistent cookies for the following purposes:

Mobile telephone numbers and SMS opt-in / consent data are excluded from the categories above and are not shared with affiliates, business partners, or other third parties for marketing or promotional purposes, and are not sold under any circumstances. See Part I, Section 5 for full details.
12. Third-Party Services
The third-party service providers we use may have access to your personal information solely to perform services on our behalf. They are obligated to handle your information in accordance with their own privacy policies and our contractual requirements. Notable third-party services include:
- Google Analytics — web analytics. You can opt out by installing the Google Analytics opt-out browser add-on. Google's privacy policy: https://policies.google.com/privacy
- Firebase — analytics service provided by Google. Same opt-out and policy as above.
- Stripe — payment processor. We do not store or collect your payment card details; that information is provided directly to Stripe. Stripe's privacy policy: https://stripe.com/us/privacy
- Twilio — SMS / MMS platform provider for the messaging program described in Part I.
13. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Usage data is generally retained for shorter periods, except when needed to strengthen security, improve functionality, or comply with legal requirements. 14. Data Transfer
Your information, including personal data, is processed at our operating offices and may be transferred to and maintained on computers located outside your state, province, country, or other governmental jurisdiction. We take all steps reasonably necessary to ensure your data is treated securely and in accordance with this Privacy Policy.

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

17. California Residents (CCPA / CPRA)
If you are a California resident, the California Consumer Privacy Act ("CCPA") and California Privacy Rights Act ("CPRA") provide you with additional rights regarding your personal information.

In the past twelve (12) months, we have collected the following categories of personal information defined under CCPA/CPRA:
- Identifiers (Category A): name, postal address, email address, IP address, account name.
- Customer Records (Category B): name, signature, address, telephone number.
- Commercial Information (Category D): records and history of products or services purchased or considered.
- Internet Activity (Category F): interaction with our website.
- Geolocation Data (Category G): approximate physical location.

Sale and Sharing of Personal Information
We do not sell personal information for monetary or other valuable consideration. We do not sell mobile telephone numbers or SMS opt-in / consent data under any circumstances.

We will respond to verifiable consumer requests within 45 days, with a possible 45-day extension when reasonably necessary. We may need to verify your identity before processing your request.
"Do Not Track" Signals
Our website does not currently respond to Do Not Track browser signals.
California Shine the Light

Our services are not directed to anyone under the age of 13, and we do not knowingly collect personal information from anyone under 13. The SMS / MMS messaging program described in Part I is intended exclusively for adult customers seeking parts and service support.

Our services may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policy of every site you visit.
21. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. The most current version will always be posted at https://www.landmarkmachinery.com/privacy-security/, with the "Last Updated" date at the top of the policy revised accordingly. Material changes will be communicated by a prominent notice on our website or by email where appropriate. Continued use of our services after changes are posted constitutes acceptance of the updated Privacy Policy.
